Terms of Service

These Terms govern bookings and interactions with Lamivar Pty Ltd (hereafter "Lamivar", "we", "us"). By booking or accepting our services you accept these Terms. Where Australian Consumer Law (ACL) provides non‑excludable rights, those rights continue to apply.

We act as principal for some services and as an agent for third‑party suppliers (hotels, transport operators, local guides). Supplier terms may apply in addition to these Terms. You must ensure you meet visa, passport, health and other travel entry requirements relevant to your itinerary.

  • Eligibility: You must be authorised to enter into contracts under Australian law.
  • Bookings: A confirmed booking requires payment as stated in your invoice/confirmation.
  • Third parties: We do not control supplier operations and are not responsible for their failure, except where required by ACL.

Booking, Payment & Cancellation Fees

Payments are processed in AUD. Payment schedules and deposits are documented in your booking confirmation. Failure to pay as required may result in automatic cancellation.

Where we collect funds on behalf of third parties, those funds may be held and transferred according to supplier terms.

Force Majeure & Amendments

We are not liable for events beyond our reasonable control (acts of government, natural disasters, pandemics, strikes, severe weather). Where travel is impacted we will seek reasonable alternatives or refunds where available from suppliers.

If you request an amendment, we will try to accommodate requests but additional charges may apply. Any refunds are governed by supplier refund policies and applicable law.

Consumer guarantees (ACL)

Nothing in our Terms excludes consumer guarantees under the Australian Consumer Law. Where services are not supplied with due care and skill or are not as described, you may have rights including remedies such as re‑performance, refund or compensation under ACL.

Refunds processing

Refunds (if due) are processed after verifying supplier refunds and may take up to 14 business days to appear on the original payment method. We will notify you by email.

Liability, Insurance & Safety

Our liability is subject to applicable Australian law. Except for non‑excludable ACL rights, we limit liability to direct losses proved and capped at the total fees paid for the affected service.

We strongly recommend clients obtain comprehensive travel insurance covering cancellation, medical expenses, personal injury, and loss of baggage. Insurance is your primary protection for unforeseen events.

You must disclose relevant medical conditions and mobility restrictions prior to booking. Some activities have minimum fitness requirements and may be declined for safety.

Where suppliers provide services, their terms and safety instructions apply. We select reputable partners and monitor compliance but do not control day-to-day operations.

Except for ACL protections, we exclude indirect, incidental or consequential losses. Our liability is limited to the value of the affected services.

Travel insurance — recommended

We recommend policies that include trip cancellation, emergency medical evacuation, and supplier failure coverage. Check exclusions before purchase.

Privacy & Data handling

Lamivar handles personal information in accordance with the Australian Privacy Act 1988 and our Privacy Policy. We collect personal data necessary to provide bookings, process payments and comply with legal obligations.

We retain data only as long as required for service delivery, fraud prevention, legal compliance or legitimate business purposes. You may request access or correction using the contact details on our Contacts page.

Governing law & Dispute resolution

These terms are governed by the laws of the State of Victoria, Australia, and the Commonwealth of Australia as applicable. Our disputes process aims to resolve matters quickly and fairly.

How to raise a complaint

  2. If unresolved, escalate to our Compliance Officer who will respond within 15 business days.
  3. If still unresolved, you may contact the Australian Competition and Consumer Commission (ACCC) or your state consumer affairs office. For financial services issues, external dispute resolution may be available.

Nothing in these steps prevents you from seeking remedies under Australian Consumer Law.
